Se declaró la nulidad de todo lo actuado en la acción de tutela promovida por el ciudadano de la referencia contra la Alcaldía Mayor de Bogotá - Secretaría de Educación Distrital, a partir del auto proferido por la Sala Civil del Tribunal Superior del Distrito Judicial de Bogotá, toda vez que la Corte encontró que el accionante la instauró ante el citado Tribunal, no obstante esta Corporación, en vez de rituarla y decidirla ordenó su remisión a la Oficina Judicial, invocando al efecto el Art. 1 del Decreto 1382 que, como ya se expuso, no resulta aplicable por ser contrario a la Carta Política.
En consecuencia, se remitió el expediente al mencionado Juzgado para que realice el trámite que corresponda conforme a la ley.

- Primero. DECLARAR la nulidad de todo lo actuado en la accion de tutela promovida por el senor Hector Elias Rojas Guayacan contra la Alcaldia Mayor de Bogota - Secretaria de Educacion Distrital, a partir del auto proferido por la Sala Civil del Tribunal Superior del Distrito Judicial de Bogota el veintitres (23) de agosto de 2000, visible a folio 29 del expediente.
- Segundo. REMITASE el expediente por Secretaria a la Sala Civil del Tribunal Superior del Distrito Judicial de Bogota, para que de manera inmediata se le imprima a esta accion de tutela el tramite que corresponda conforme a la Ley.
